Customer Rights

If the merchant fails to provide the service in accordance with the contract:

In the event of delay or a defect, the customer must allow the merchant a reasonable additional period to provide the service or remedy the issue, unless this is impossible due to the nature of the service or would require disproportionate expense.

When determining whether an expense is disproportionate, the following must be considered:

a) The price of the goods or service if it complied with the contract;

b) The degree of non-compliance with the contract;

c) The possibility of resolving the issue without causing inconvenience to the customer.

If the additional period expires without result, the customer is entitled to:

a) Have the service provided or the issue resolved by a third party at the merchant’s expense;

b) Request a reduction in the service price;

c) Cancel the contract and request compensation in accordance with Georgian law.

Granting an additional period is not required if it is clearly ineffective or if timely service was essential to the customer.

If the merchant does not begin the service on time or delays it unjustifiably, making timely completion impossible, the merchant has no right to claim reimbursement of expenses or payment if the customer has lost interest in partial performance.

The customer may exercise their rights under the Law of Georgia on the Protection of Consumer Rights within 2 years from the date of violation.

Force Majeure

Neither party shall be liable for full or partial failure to perform obligations if such failure is caused by natural disasters, technological catastrophes, fire, war, or government decisions, provided these events occur after the order is placed.

If such circumstances affect the performance period, the deadline will be extended accordingly.

The affected party must notify the other party about the occurrence, expected duration, and end of such circumstances.

The facts stated must be confirmed by a competent authority (such as a chamber of commerce or other relevant authority).

Failure to notify, or delayed notification, removes the right to rely on force majeure as grounds for exemption from liability.
